Yeah, if there's an updated one. Use that. The version your using is important. Espically if the texture pack is old and there's new items that Notch/Jeb added.

I just created this one myself. Its 1.2.4 files. 1.2.4 mcpatcher im using with it also

Im not really sure what you are asking but i would suggest getting a different texture pack, And if you cant change it through the game because it crashes go to your .minecraft fold-into your texture packs folder and delete that texture
