I see alot of server using the inactive herochat plugin, but how? is it a different version?

I'm not sure, as Herochat is currently deemed under construction on Bukkit. They probably used a version that was compatible with 1.3 or so before it went under construction. In this case you'll have to wait until it finishes or get an old JAR compatible with the current Herochat.
