Texture pack help

Okay, so I started my cartoon 128x texture pack yesterday and I've been doing a lot and I wanted to publish it as V1 but I made it over the Sphaxcraft texture pack and there are lots of parts of the Sphaxcraft that I didn't do, am I aloud to publish it anyway if I say I didn't make those?
