i would but when i remove the white it comes up saying i can not upload this skin ... blah blah.... transparent...blah.... will show up black, fix and upload

Try to remove the white in the hat layer and replace it with transparent (so the preview doesn't have a big block of white around its head). Also you shouldn't use pure black in a skin, use desaturated colors instead. Overall, it is a second skin (compared to mine)! :D
